WELLINGTON CTY. - A Wellington County OPP sergeant, arrested and charged after a recent road rage incident, has now been suspended.

He was not on duty at the time.

Sergeant Rui Pacheco, a 19-year officer, was charged with two counts of assault and two counts of uttering threats.

“It was an altercation that took place after an incident that had happened while driving, with a few other parties in another vehicle,” said Alanna Russell, Waterloo Regional Police Service spokesperson.

Pacheco was arrested by Waterloo Regional Police on March 14 at around 7am, one day following the incident in Cambridge.

The OPP Professional Standards Branch (PSB) has launched an investigation into the incident, which could lead to charges under the Police Services Act.

OPP spokesman Sergeant Dave Rektor said the matter was being investigated internally but did not provide details.

Pacheco was suspending follwing a meeting with the PSB on March 16.

Wellington County OPP detachment commander Inspector Scott Lawson said, “I’m confident (in) the process ... we’ll trust that process, and it’ll follow as it should and I would hope that we haven’t lost the public’s confidence in our organization and in our detachment in particular."

OPP officer found in guilty in road rage assault

Postby Thomas » Sun Sep 30, 2018 1:27 am

An OPP officer has been found guilty of assault in connection to an off-duty road rage incident.

In 2016, Sergeant Rui Pacheco was driving along Dundas Street in Cambridge.

He became angry with a man driving a truck and the two pulled into a grocery store parking lot near Franklin Boulevard.

Witnesses said Pacheco aggressively parked his SUV and confronted the man and his female passenger.

They testified that a fight broke out, with Pacheco throwing the first punch.

One said Pacheco kicked the man in the mid-section.

When one witness asked what happened Pacheco allegedly replied: "Road rage happened."

The court also heard that the officer’s family, including his children, were in the vehicle at the time and tried to prevent him from confronting the couple.

Pacheco was arrested and charged with assault the next day.

He was suspended with pay while waiting for the end of his trial.

According to the Sunshine List, his salary in 2017 was $120,000.

On Friday a judge found Pacheco guilty of assault, saying: “I am satisfied he lost control. Pacheco was the aggressor and at all times controlling and dominating.”

Pacheco will be sentenced on December 5.

He could receive anything from an absolute discharge to time behind bars.

Pacheco is a 21-year veteran with the OPP.

OPP officer could face jail time over off-duty road rage inc

OPP officer could face jail time over off-duty road rage incident

An OPP officer could be facing jail time for an off-duty road rage incident that happened in 2016.

Sgt. Rui Pacheco was in court Thursday for his sentencing hearing.

The defence in the case wants a conditional discharge. The Crown disagrees, calling for Pacheco to spend one or two months in jail, saying the attack was a public and brazen one.

The man was convicted last fall and found guilty of assault after a judge ruled that he was the aggressor in the incident.

A judge heard that he was driving along Dundas Street when someone driving a truck cut him off then pulled into a grocery store parking lot.

Witnesses testified that Pacheco followed the truck, confronted the couple inside and threw the first punch.

Pacheco threw multiple punches and kicked the man in the section before he left. He was overheard saying, “Road rage happened.”

The judge ruled that he was the aggressor and at all times was controlled and dominating.

The victim’s wife gave a victim impact saying that day was the worst day in her life, calling the attack malicious and heartless. She spoke about how she now has a constant fear of police and first responders.

The defence says that Pacheco was suffering from post-traumatic stress disorder, claiming that it was ignored by the OPP. The defence also says that, if it weren’t for the actions of the driver, Pacheco wouldn’t have become unhinged in the moment.

The Crown says Pacheco is not the victim in the case and that this wasn’t just a fight but a beating, one where an off-duty officer failed miserably at upholding a higher standard.

Pacheco was originally suspended with pay when he was charged in early 2016. He then went onto long-term disability after he was diagnosed with PTSD.

The judge heard that he retired in March 2019.

A sentence will be handed down on May 30.

OPP officer charged in off-duty road rage incident gets sent

‘Fair compromise’: OPP officer charged in off-duty road rage incident gets sentenced

An OPP officer charged in an off-duty road rage incident in 2016 has been sentenced.

Sgt. Rui Pacheco was sentenced to 45 days of house arrest on Thursday.

The judge ruled that the officer’s post-traumatic stress disorder warranted rehabilitation rather than jail time. Pacheco’s lawyer, Leo Kanahan, says the sentencing seems fair.

“It’s a fair compromise. We asked for conditional discharge but His Honour rightfully turned around and said it’s difficult under the set of circumstances that we found ourselves in,” Kanahan explains. “But given Mr. Pacheco’s history he wasn’t deserving of jail on this either. So it’s a fair compromise, in my estimation.”

He was convicted last fall and found guilty of assault after a judge ruled that he was the aggressor in the road rage incident.

Pacheco will be allowed out of the house daily from 8:30 a.m. to 11 a.m. to go to the gym as part of his PTSD rehab.

Otherwise, he will only be allowed out for four hours on Tuesday afternoons for the necessities of life.

The sentence came down as a conditional sentence—after 45 days, Pacheco is subject to 12 months of probation.
