An OPP officer has been charged with assault causing bodily harm linked to an incident where a woman was hurt while in a cell at the Orillia OPP detachment, the provincial Special Investigations Unit (SIU) says.

According to a news release issued Wednesday morning, the incident started at around 1:15 a.m. on Sept. 7, when OPP officers arrested a 43-year-old woman outside the Studabakers Beachside in Orillia and took her to the local detachment.

The SIU says that while in the cell, something happened between the woman and an officer, but the news release offered no details about what actually occurred.

The woman was taken to hospital for treatment, the SIU said. She then returned to hospital two days later, and that's when she was diagnosed with a serious injury, according to the news release.

The SIU also noted in the release that the issue wasn't raised by any police service, but was brought to the attention of the police watchdog by a member of the public in April of 2020 — seven months after the alleged incident occurred.

Const. Bailey Nicholls is now facing a charge of assault causing bodily harm. The officer is set to appear in court next month.

Orillia OPP officer charged with assault following SIU probe

After being arrested at restaurant, woman had an 'interaction with a police officer' in the cell of the Orillia OPP detachment and sustained serious injury

The Director of the Special Investigations Unit (SIU), Joseph Martino, has reasonable grounds to believe an Ontario Provincial Police (OPP) officer committed a criminal offence in relation to an interaction with a 43-year-old woman in September of 2019.

As a result, Director Martino has caused a charge to be laid against the officer. The matter was brought to the attention of the SIU by a civilian on April 15, 2020.

The SIU investigation determined that at approximately 1:15 a.m. on Sept. 7, 2019, OPP officers arrested a woman outside the Studabakers Beachside in Orillia and transported her to the Orillia OPP detachment.

While in a cell, the woman became involved in an interaction with a police officer. She was taken to hospital for treatment. Two days later, the woman returned to hospital and was diagnosed with a serious injury.

As a result of the SIU investigation, OPP Constable Bailey Nicholls has been charged with one count of assault causing bodily harm, contrary to s. 267(b) of the Criminal Code.

The officer is required to appear before the Ontario Court of Justice at 700 Memorial Ave. on Feb. 9, 2021.

The matter is now properly before the courts. In consideration of the fair trial interests of the accused, the SIU will make no further comment pertaining to this investigation.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must:

- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations

SIU charges Orillia OPP officer with assaulting a woman in custody

BARRIE, ONT. -- Ontario's police watchdog, the Special Investigations Unit (SIU), has charged a police officer with assault following an incident that occurred in Orillia in September 2019.

In a news release, the SIU says it has reason to believe an OPP officer committed a crime during an interaction with a 43-year-old woman.

On September 7, 2019, OPP officers arrested the woman outside the Studabakers Beachside restaurant in Orillia and brought her to the Orillia OPP detachment.

The SIU says that while in a cell, the woman had "an interaction with a police officer," after which she was taken to hospital for treatment.

Two days later, the woman returned to the hospital and was diagnosed with "a serious injury," the agency says.

OPP Constable Bailey Nicholls is charged with assault causing bodily harm. The officer is expected to appear in court on February 9, 2021.

Orillia OPP official says officer is on administrative duties in wake of charge that followed an SIU investigation of 2019 incident in cell at Orillia detachment

An Orillia OPP officer, who is facing a charge of assault, remains on the job, officials have told OrilliaMatters.

Bailey Nicholls was charged with assault following an investigation by the Special Investigations Unit (SIU) into an incident that occurred in the fall of 2019. The SIU issued a press release about the charge earlier this week.

Const. Ted Dongelmans, a media officer with the Orillia OPP detachment, says Nicholls is “on administrative duties” in the wake of the charge.

When asked if that was common practice when an officer faces a criminal charge, he said the case is considered individually.

“Officers found guilty of less serious criminal acts and/or behavioural breaches may be rehabilitated through education, discipline and supervision,” he told OrilliaMatters.

The SIU investigation determined that at approximately 1:15 a.m. on Sept. 7, 2019, OPP officers arrested a woman outside Studabakers, a waterfront restaurant/bar, and transported her to the Orillia OPP detachment on Peter Street.

While in a cell, the woman became involved in an interaction with a police officer, noted the SIU. The woman was taken to Soldiers’ Memorial Hospital for treatment. Two days later, the woman returned to hospital and was diagnosed with a serious injury.

As a result of the SIU probe, Const. Nicholls was charged with one count of assault causing bodily harm, contrary to s. 267(b) of the Criminal Code.

The officer is required to appear before the Ontario Court of Justice at 700 Memorial Ave. on Feb. 9, 2021.

Judge apologizes to Orillia OPP officer, accused in assault case, for court delay

Bailey Nicholls was charged following an SIU investigation and is set to learn the judicial verdict in October

A Durham Region judge has apologized to an Orillia OPP officer on trial for the delay in court proceedings.

"This has been a long road, four years and counting," Justice John Olver said in an Orillia courthouse June 12. "It will be an excess of four years once we get to October. I ask for your patience."

Olver was speaking to OPP Const. Bailey Nicholls, who is facing a charge of assault causing bodily harm. The case stems from a 43-year-old woman's arrest in front of Studabakers Beachside on Sept. 7, 2019.

According to Special Investigations Unit director Joseph Martino, the woman was arrested around 1:15 a.m. and was taken back to the Orillia detachment and placed in a cell. While there, she had an interaction with a police officer.

The woman was subsequently taken to Orillia Soldiers' Memorial Hospital for treatment, but, two days later, returned to hospital and was diagnosed with a serious injury.

It was a resident who brought the allegations to the attention of the SIU on April 15, 2020, Martino said. Following further investigation, a criminal charge was laid against Nicholls in January 2021.

Her trial began June 5 in Orillia. Defence lawyer Mike Miller on June 12 requested to present his final submissions in electronic form, which Olver allowed.

Allowing time for both sides to present their written submissions, and acknowledging Miller's vacation in mid-September, the matter is set to return to Orillia court for an expected verdict Oct. 26.
