Crown cites concerns over 'obstructive behaviour' on the part of police

The son of an Ontario Provincial Police officer who's facing more than 100 charges alleging sexual assault, making and distributing child pornography and bestiality made a court appearance on Friday.

Shayne Lund, 22, mouthed the words 'are you OK' to his father who was in the front row of a Barrie, Ont., courtroom. His father, Mark Lund, nodded yes.

The case involves Lund and two other co-accused women who have been described as his girlfriends — 19-year-old Kathryn Thompson and 20-year-old Avery Taylor.

The CBC's Shannon Martin said the OPP have released virtually no information in the case and the Crown prosecutor Indy Kandola has cited "serious concerns about obstructive behaviour."

On Friday the Crown handed over a hard drive containing a significant amount of material to the defence lawyers.

Sgt. Peter Leon told CBC that the "investigation is ongoing."

"There's a number of people who need to be spoken to, potential witnesses, victims as well, and we don't want to compromise the integrity of the investigation," he said.

The victims identified so far are all young girls between the ages of two and 10 years old.

Angela McLeod, the lawyer for Thompson, said she has raised concerns over the OPP investigating the family of one of their own officers.

"Should the OPP officers who are investigating have been doing so ?" she said. "Should they continue on the case? Where was Mr. Lund Jr. living at the time?"

Crown expects many more charges as 'substantial amount' of material is pulled from computers, cell phones.

COP 'OBSTRUCTIVE' IN SON'S CHILD SEX, BESTIALITY CASE: CROWN

BARRIE, Ont. — More charges are expected against a Midland, Ont., man already charged with 110 sex-related offences against pre-school children and animals.

Shayne Lund, 22, charged with conspiring to kidnap and drug a child, sexually assaulting children, creating child pornography and bestiality, made a court appearance Friday but has not yet had a bail hearing.

Several family members of alleged victims filled the courtroom as Lund appeared in the prisoner's box in handcuffs.

"Creep," one family member whispered.

Sitting in the front row of the court, Lund's mother and father sat quietly. As Crown attorney Indy Kandola told the court the investigation is ongoing, with even more charges expected to be laid, Lund's mother began to weep.

Kandola asked the court to order that Lund not be allowed to contact his father, Mark Lund — who is an Ontario Provincial Police officer — alleging the father has been "obstructive" in the investigation.

"I can indicate the Crown is concerned about Mark Lund's obstructive behaviour during the course of this investigation," Kandola said.

The father is also a potential witness in the case, he said.

Cellphones, computers and a video camera were seized from the father's home, where his son lived at the time of the arrest.

"The father is a witness to the video camera and the way it was pointed at the bed," Kandola told the court, adding that the father also told police "that his son fantasizes about children."

However, Justice Dennis Wilson refused to make the no-contact order, saying she did not "wish to remove Mr. Lund's only potential surety."

Outside of court, Lund's lawyer, Eginhart Ehlers, confirmed more charges are expected to be laid against Lund, but said it was not appropriate to comment on what they will be.

"My client is innocent unless proven guilty in a court of law," said Ehlers. "It would not be fair to try the case in the media."

Lund was charged in September along with two of his girlfriends, who are each facing 16 similar allegations and are now in custody.

Avery Taylor, 20, of Orillia, Ont., was denied bail and Kathryn Thompson, 19, waived her right to a bail hearing last week and has consented to her detention.

In an interview outside court last month, the mother of one of the alleged victims, who cannot be identified, said her five-year-old daughter was allegedly blindfolded while being babysat and given a taste test that involved tasting ketchup chips and, unknown to the child, strawberry and banana-flavoucared condoms.

The mother said she had entrusted Taylor to babysit her child for several years and remains haunted with details she has learned.

"I trusted her since she was a young girl," said the mother. "I will never trust anyone again."

Several other children are involved. The Crown has announced that the charges are so disturbing that, if found guilty, it will be seeking dangerous offender status for all three accused.

Lund is expected back in court Dec.16 when a date for a bail hearing may be set.

An OPP officer has been ordered not to communicate with his son, who faces 110 sex-related charges involving young children.

Justice of the Peace Ann Forfar ordered Const. Mark Lund of the South Georgian Bay detachment not to communicate with Shayne Lund, 22, who has been in custody since his arrest in September.

Lund of Midland is charged with conspiring to kidnap and drug a child, sexually assaulting children, creating child pornography and bestiality. Some parent’s of the victims, including a five-year-old girl, were in court.

Forfar agreed to place a non-communication order on Lund’s father because he is considered a Crown witness. The case is so disturbing the Crown has already announced it will seek dangerous offender status if there is a conviction.

“This person is a potential witness although you always wonder about a family member being a witness,” Forfar said as she ordered the father and son not to communicate.

Forfar’s decision didn’t come easily as she admitted “wavering” during Monday’s hearing because Mark Lund, a veteran OPP officer, may be his son’s only surety if he is ever allowed bail.

However, Forfar decided there is nothing to stop Lund’s father from applying as a surety at an upcoming bail hearing even if he isn’t allowed to communicate with his son at this time. A non-communication order can be lifted by a judge at any time.

Lund senior sat through the first half of Monday’s proceeding with his son sitting about two metres away in the prisoner’s docket. However, the OPP officer was not in the courtroom when Forfar announced her decision later in the day.

Court heard the father and son lived together in a small Midland house before the younger Lund was taken into custody. OPP officers seized computers, cell phones and a wall-mounted camera from the home as part of their ongoing investigation.

“This is a very small place and the father would have been aware of a camera pointed at one of the beds,” Crown attorney Indy Kandola said, offering reason why Lund senior was on his witness list.

“I expect more charges to be laid,” Kandola said. “Because this is ongoing, there is a necessity to preserve the integrity of the case.”

None of the allegations have been proven in court.

In an earlier hearing, Kandola accused Mark Lund of being obstructionist during the ongoing investigation into his son and subsequent court proceedings.

But Shayne Lund’s lawyer, Eginhart Ehlers, said if there are allegations of obstruction, they should be investigated by police instead of being the subject of a non-communication order.

“That should be a separate matter, if that were to happen then police should lay charges,” Ehlers said.

Lunds two co-accused — Avery Taylor, 20, and Kathryn Thompson, 19, — also remain in custody. Taylor made bail but was arrested again after more charges were laid. Thompson voluntarily waved her right to a bail hearing.

The allegations in the case, which involve sexually assaulting children and animals, have garnered the attention of the national media.

Lund is back in court Jan. 15.

OPP investigators have alleged there are eight additional child victims in a sexual assault case that includes accusations of bestiality, conspiracy to kidnap a child and the making of child pornography.

Police have also introduced new allegations some children were drugged before they were sexually assaulted.

Shayne Lund, 22, of Midland, has been in custody — along with two friends — since last October, charged with 110 counts including child sexual assault, making child pornography and conspiring to kidnap and sexually assault a child.

Avery Taylor, 20, of Orillia, is facing 20 charges and Kathryn Thompson, 19, of Orillia, faces 26 offences.

The new allegations include administering a noxious substance to children as young as two years old, coercing children to have sex with animals, coercing them to commit voyeurism along with them and videotaping them in sexual acts.

The mother of one of the children at the centre of the case was outraged to learn about allegations her preschooler was drugged.

“I just feel like I’m going to lose my mind,” the mother said, weeping as she spoke QMI Agency outside of court. “This sickens me.”

The three were initially charged last September when it was believed only five children from ages two to five were allegedly victimized. With the eight additions, there are now 13 complainants. There is a ban on publication of the identities of all victims.

The new allegations include mischief by damaging the bed sheets of a 10-year-old and the theft of underwear. Another charge alleges Lund forced a 14-year-old girl to perform sexual acts and bestiality while being videotaped, then threatened to show the videos to her father if she didn’t provide further sexual favours.

While Lund allegedly acted alone in most of the charges, Taylor or Thompson are accused in many cases of assisting him or committing the acts on their own.

According to one allegation, a five-year-old child was blindfolded and tricked into a game of taste testing, with bowls of chips and other flavours — including a person allegedly wearing a strawberry-flavoured condom.

In October, Taylor had a lengthy two-day bail hearing and was denied bail. Thompson waived her bail and agreed to remain in custody.

One of Shayne Lund’s alleged victims says she was troubled to learn of the accusations involving small children.

“He went out with a lot of girls,” said the 19-year-old, who was 14 at the time police allege that Lund sexually assaulted her. “But when it comes to children and animals though, he never showed any signs of interest. In fact, he always said he didn’t like kids.”

While most of the new allegations against Lund are from the year 2013, at least two accusations of sexual assault date to 2009 and 2010.

The woman said she met Lund at a time in her life when her self-esteem was very low.

“He preyed on girls with low self-confidence and low self-esteem … that’s when he got to me,” she alleged.

She said at first, Lund was kind to her.

“It was at a time in my life when I needed attention. He made me feel special. He knew exactly what to do and say to make them feel special.”

Lund is now facing 110 charges including sexually assaulting children, administering noxious substance, bestiality, voyeurism, and creating child pornography.

Two of Lund’s girlfriends also face charges. Avery Taylor, 20, of Orillia, is accused of 20 offences and Kathryn Thompson, 19, of Orillia, is facing 26 counts.

The complainant said she knew all three when they were in their early teens and recalled Taylor seemed obsessed with Lund.

“Avery was a really nice person. She was smart — but she had very low self-esteem,” the woman added. “Shayne gave her attention and she thrived on it. She was blind to him.”

Now, years later, she wonders if she should have come forward to police before allegations first appeared. She went to investigators recently with allegations that date to 2009.

“It’s hard thinking that maybe if I had have said something before, some of this could have been avoided.”

Still, she insists she is not a victim, no matter what police call it, adding “I prefer to call myself a survivor.”

In the fall of 2013, a teenage girl went to the police – she was underage, and she told officers she had had sex with Shayne Lund.

But she said she only went to police because Lund asked her for naked pictures of her little sister, who was about 9-years-old. The teenager testified that she told Lund, “You know how old I am right?" and he responded, "Yes I like them young."

She also testified that Lund asked if she thought her little sister, "Could be trained to perform sexual acts?"

The teenager cannot be identified because she is a victim in the case. Until now, none of the evidence from the preliminary hearing could be reported. Lund pleaded guilty on Tuesday to 35 charges, which means evidence presented to the court can be reported.

The charges are disturbing and include making, possessing and distributing child pornography. They also include six counts of sexual assault, involving six different victims, some as young as four-years-old.

He also admitted to seven other charges of planning to sexually assault underage girls and one adult and also conspiring to drug a child.

In addition, Lund pleaded guilty to bestiality and conspiring to get some of his young victims to perform sexual acts with animals too.

One victim, again a teenager, told the court, “He asked me to have sex with horses... and dogs." But the girl said she couldn't go through with it. Lund also made a secret pornographic recording of another girl.

All these crimes happened in Orillia, Penetanguishene, and Waterloo, mostly in the summer of 2013.

Yet another victim under the age of 16 told the court, “He would try and take my clothes off and I would say no… but I felt like if I didn't do it, it would upset him."

On the day of the arrest, the OPP issued a release, which identified Lund by name. The very next day the OPP issued a retraction, saying the information could not be reported.

Since then, the case has been making its way through the courts for nearly a year and a half.

At the time of some of these incidents, Lund was living with his father, Mark Lund, an OPP officer. Some victims testified some of the crimes happened at his house. Mark Lund was never allowed in the courtroom because he was a potential witness, but never ended up testifying.

When leaving court on Tuesday, Mark Lund had little to say about his son's guilty plea.

Lund's guilty plea was the third to come in this case. He had been jointly charged with Avery Taylor and Kathryn Thompson. Both women entered their guilty pleas earlier this year. Thompson pleaded guilty to 11 charges and Taylor to 10 charges.

Taylor's charges include conspiring to drug a child, making child pornography and sexual assault. Several witnesses said that Taylor would often babysit children, sometimes with Lund.

Court documents show Thompson admitted to bestiality offences and conspiring to drug a child.

Lund, Taylor and Thompson will all be assessed by a forensic psychiatrist. That will help determine if any of them will be considered dangerous offenders, but in the end it will be up to the judge to make that decision. That process will take several months.

As of right now, all three remain in custody.

OPP officer’s son, who pleaded guilty to sex crimes against kids and animals, designated dangerous offender

BARRIE, Ont. — An Ontario man who pleaded guilty to sex crimes against young children and animals has been designated a dangerous offender.

A Barrie, Ont., judge said Shayne Lund has shown a “complete inability to control his sexual impulses” and only expressed a desire to do so after his arrest in 2013.

Justice Joseph Kenkel told the court Lund could not be trusted to commit to psychological treatment given his “history of manipulation and deceit” and that sexual gratification has so far been the main focus of his life.

The dangerous offender designation means Lund could be imprisoned indefinitely.

Lund pleaded guilty to 35 charges including sexually assaulting and conspiring to sexually assault children as young as two years old, bestiality, and making child pornography.


Court has heard Lund recruited his girlfriends, one of whom worked in early childhood education, to help him find children to sexually assault.

Both women were sentenced as long-term offenders after pleading guilty to 11 charges.

Lund’s father, an Ontario Provincial Police constable, appeared distraught as the ruling was read in court Wednesday.

Mark Lund, a 27-year veteran of the force, was recently charged with obstruction of justice.

Police have released no other details but say he was off-duty at the time of the alleged offence.
