Const. Miriam Green charged with dangerous driving causing bodily harm

Peterborough County OPP Const. Miriam Green has pleaded guilty to careless driving.

Green was originally charged with dangerous driving causing bodily harm by the Special Investigations Unit (SIU), following a crash on Highway 7 in February 2018.

On March 28, Green's lawyer, Sandy Khehra, entered the plea on his client's behalf in front of Justice Jennifer Broderick. Broderick fined the officer $400 for the Highway Traffic Act (HTA) violation. Provincial Crown attorney Peter Scrutton, who read in the agreed statement of facts, said it was unlikely the Crown would have been able to prove criminal culpability if the matter went to trial, but Green was driving without due care and attention as defined by the act.

According to the facts, Green left the Peterborough OPP attachment around 5:15 p.m. on Feb. 6, 2018, to respond to a women trapped in her vehicle on Highway 7. While driving east on the highway, two ambulances were also travelling on the highway. Motorists on both sides of the highway began pulling over to the shoulder for them, including Kirk Paul. Once the eastbound ambulance passed his vehicle, Paul pulled out from the shoulder and began to make a U-turn across the lanes of the highway when Green's cruiser stuck the left rear of Paul's vehicle.

"It was a one-in-a-million chance," said Khehra.

Paul's vehicle went into the north ditch, ejecting both Paul and his dog. Paul was seriously injured and airlifted to a Toronto hospital. His dog died.

"Mr. Paul has no memory of this event," Scrutton said.

According to GPS data for the vehicle, Green was travelling 163 kilometres per hour and increased her speed to 169 kilometres per hour until 1.1 seconds before the crash, before slowing to 139 kilometres per hour immediately before impact.

"She herself suffered injuries," added Khehra.
