OPP officer charged in death of woman in cruiser crash

A northwestern Ontario provincial police officer is facing a charge following an investigation into the death of a 42-year-old woman by the province's police watchdog.

The Special Investigations Unit says Gloria Assin was killed as officers were transporting her to the Kenora, Ont., detachment early on Sept. 23.

Assin died in a collision between the marked cruiser and a tractor trailer at Highway 17A and Redditt Road. She had been picked up for public intoxication and was sitting — unbelted — in the back of a cruiser. She died of massive head injuries when the cruiser was rear-ended.

SIU director Ian Scott said Const. Troy Bender is facing one charge of dangerous driving causing death, and is to appear in court in Kenora on Dec. 20.

The SIU is an arm's length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault.

Police officer charged after fatal crash

A Kenora OPP officer has been charged in connection with the death of a Grassy Narrows woman in a traffic accident earlier this year. Const. Troy Bender is facing a charge of dangerous driving causing death. His first court appearance is set for December 20th.

The charge is laid following Ontario's special investigations unit report into the fatal accident in September at the junction of Redditt Road and Highway 17. Following the accident, the Ontario Provincial Police reported the following information to the SIU:

• On September 23, 2012, at approximately 2:00 a.m., officers were transporting a woman in custody to the Kenora detachment.
• At Highway 17A and Redditt Road, there was a collision between the marked cruiser and a tractor trailer.
• The woman died as a result of the collision; the officers and the driver of the tractor trailer did not sustain serious injuries.

Three investigators, two forensic investigators and one collision reconstructionist from the Special Investigations Unit investigated the incident. The findings were released by the investigators Thursday night.

The city has complained about safety issues related to the intersection in the past, and city council renewed their concerns on behalf of residents, following the fatal collision.

The officer is compelled to appear before the Ontario Court of Justice at 216 Water Street in Kenora on December 20, 2012. The Justice Prosecutions branch of the Ministry of the Attorney General will have carriage of the prosecution.

As this matter is now before the courts, and in consideration of the fair trial interests of the charged officer and the community, the SIU will make no further comment pertaining to this investigation.

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must consider whether an officer has committed a criminal offence in connection with the incident under investigation depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid report the results of any investigations to the Attorney General.

SIU charges Kenora OPP officer with dangerous driving causing death

A Kenora OPP officer is facing dangerous driving causing death charges following a Special Investigations Unit (SIU) investigation into the death of a 41-year-old prisoner in police custody in September.

The SIU was called in to investigate after Gloria Assin was killed when an OPP cruiser collided with a tractor trailer unit at the intersection of the Redditt Road and the Highway 17A bypass around 2 a.m. Sept. 23.

In a release issued Thursday evening, the SIU reported director Ian Scott “has reasonable grounds to believe that an Ontario Provincial Police officer committed a criminal offence in relation to the death…”

Const. Troy Bender is scheduled to appear in a Kenora court Dec. 20. The Justice Prosecutions branch of the Ministry of the Attorney General carry out the prosecution.

The SIU is a civilian, arm’s length agency that investigates police involved in complaints of death, serious injury and allegations of sexual assault.

With the matter before courts, the SIU offered no further comment on the investigation.

A Kenora detachment OPP officer charged with dangerous driving causing death has been ordered to stand trial.

Const. Troy Bender was charged in November by the province's Special Investigations Unit.

He was driving an OPP cruiser on Sept. 23 when it collided with a transport truck.

Gloria Assin, 42, was killed. She was in the back seat in police custody at the time.

A preliminary hearing was held, and the judge announced on Friday that there is enough evidence to proceed to trial.

There's no word on when that trial will begin.
